Jonathan has more than three decades of experience litigating high-stakes cases for corporate and individual plaintiffs and defendants in courts across the country. He has tried cases and argued appeals in matters with stakes ranging from hundreds of thousands to billions of dollars.
A commercial litigator with broad experience, Jonathan has represented clients in antitrust, securities, intellectual property and trade secrets, non-compete, unfair competition, contract, partnership, professional liability, class action, and other complex commercial disputes in federal and state courts and before arbitral tribunals.
Assumed defense of a Video Privacy Protection Act class action in the E.D. Va. seeking millions in statutory and punitive damages. Filed a counterclaim and a motion attacking plaintiff’s claims; one business day after oral argument, plaintiff’s counsel contacted me seeking a walk-away settlement. Result: Complete victory in under two months.
Represented the buyer of a $31 million parcel that had agreed to pay the seller more if, at the buyer's discretion, it redeveloped the property in a specified way. When the real estate market collapsed, the client declined to redevelop and listed the property for $14 million. The seller recorded a lien to block the sale and sued for the additional purchase price. The seller coupled his breach of contract claim with a claim for rescission. We accepted the rescission, tendered the property back, and counterclaimed for return of the $31 million purchase price. Result: The seller released the lien, dropped his claim, and paid the client's legal fees.
Helped Barclays defeat a $13 billion fraud claim while recovering $8.3 billion on its affirmative contract claims following a lengthy bankruptcy trial and appeals to the SDNY and the Second Circuit.
Successfully represented Barclays in multiple actions brought by partners of a defunct Wall Street law firm asserting fraud, RICO, and contract claims related to capital loan obligations.
Successfully defended Qwest against multiple individual and class securities fraud and RICO actions seeking multi-billion-dollar damages.
Successfully represented Genesco in a bench trial against UBS and Finish Line. The court rejected the defendants’ fraud, securities fraud, and material adverse event claims and ordered Finish Line to close on its $1.5 billion acquisition of Genesco. The case later settled for $175 million plus 12% of Finish Line’s stock.
Co-lead counsel for a class of municipal entities in antitrust litigation arising from bid-rigging in the municipal derivatives industry. Recovered $240 million for the class and received the American Antitrust Institute’s Award for Outstanding Achievement in Private Antitrust Litigation.
Co-lead counsel for a shareholder class in a securities fraud action against Genzyme; the class recovered $64 million.
Successfully defended REI against hundreds of millions of dollars in claims brought by Bank of America and Chase related to affinity credit card programs.
Assumed defense of a law firm in a dispute with former partners after the client had lost a substantial jury verdict at trial. Following post-trial motions that reduced the damages award by more than 95%, the case settled on favorable terms.
Represented a group of partners who left a major law firm in a compensation dispute; the case settled for the full amount claimed.
Successfully represented a major law firm in a confidential arbitration involving a multi-million-dollar fee claim and a malpractice counterclaim exceeding $50 million.
